Tenant Eviction case in respect of rent arrears only.
Costings ExplainedOur
costs are charged at £200 per hour or part therof. Each routine
telephone call, email, letter, fax in or out is charged at one tenth of
the hourly rate. Our work is thus limited to 25 hours in respect of the
Court Eviction Service fixed fee of £65. Any additional work over and
above 25 hours will be charged at our standard rates. Obviously we
always aim to resolve tenant eviction matters within the alloted
time-frame wherever possible.
Court Eviction Service Conditions- Agreement of our general terms of business.
- You
are not aware of any rent arrears due or pending from the tenant to
which you may after signing up yo the Court Eviction Service require us
to evict the tenant for rent arrears.
- The rent arrears must be
a minimum of 3 months before we agree to act and represent you and your
tenant must have paid at least 3 months rent in full and on time prior
to instructing us.
- The tenant must have passed a credit check
undertaken by us before this agreement is signed or if you have already
undertaken your own credit checks to forward these to us for
verification.
- The agreement you have with your tenant must be
in writing and signed and complies with all necessary statutory and
regulatory conditions. It must be an Assured Shorthold Tenancy
(herinafter AST) where the subject property is located within England
and Wales created on or after the 28th February 1997.
- You must
keep a full record of all payments made and received from the tenant
together with supplying us with a copy of the AST agreement. If you do
not supply all of the necessary to enable us to commence court eviction
proceedings for rent arrears we reserve the right to refrain to act for
you until such time as you have supplied the relevant information.
- You
must report a rent arrears case to us within the first 90 days of the
period where the tenant is more than 3 months in rent arrears.
Notification must be in writing and by phone on 0871 218 1081.
- The tenant must be over 18 years of age.
- You must not allow the tenancy agreement to be assigned to another individual or organisation.
- We
reserve the right to instruct agency solicitors or barristers to
represent you at any court eviction hearing and shall not be
responsible for their acts or omissions.
- If you or your agent
have undertaken the preparation work to evict your tenant and such work
is wrong or incomplete, we are under no obligation to commence court
eviction proceedings if, in our absolute discretion, consider that
there is no reasonable chance to evict the tenant.
